General terms and conditions of business

§ 1 Scope

For the business relationship between the web shop operator HerEXTENSIONS, Ms. Mandy Eigler, Rothenbergstr. 26, 86316 Friedberg (hereinafter “Provider”) and the customer (hereinafter “Customer”) exclusively the following General Terms and Conditions apply in the version valid at the time of the order. Differing general terms and conditions of the customer will not be recognized unless the provider expressly agrees to their validity in writing.
The customer is a consumer to the extent that the purpose of the deliveries and services ordered cannot be predominantly attributed to his commercial or independent professional activity. On the other hand, an entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or independent professional activity.

§ 2 Conclusion of contract

The customer can select products from the provider's range, in particular hair extensions made from natural hair, accessories for attaching and caring for hair extensions, as well as cosmetic products, and collect them in a so-called shopping cart using the "add to shopping cart" button. Using the “order with payment” button, he submits a binding application to purchase the goods in the shopping cart. Before the order is dispatched, the customer can change and view their data and the products in the shopping cart at any time. The customer can only submit the application and transmit it to the provider if the customer accepts the present contractual conditions, which are made available to him again via a hyperlink for retrieval and printing, by selecting the “ACCEPT TERMS AND CONDITIONS” checkbox and thereby includes them in his application has.

Upon request, the provider sends the customer an automatic confirmation of receipt by email, in which the customer's order is listed again and which the customer can print out. The automatic confirmation of receipt merely documents that the customer's order has been received by the provider and does not constitute acceptance of the application. The contract is only concluded when the provider submits the declaration of acceptance, which is confirmed by a separate order confirmation by email, but at the latest by Shipping notification will be sent via email. § 3 Delivery conditions, availability of goods, retention of title

The stated delivery times are calculated from the time we conclude the contract, assuming prior payment of the purchase price (except: purchase on account). If no or no different delivery time is specified for the respective goods, it is three to five working days.
The provider is entitled to make partial deliveries if this is reasonable for the customer.
If no copies of the product selected by the customer are available at the time of the customer's order, the provider will inform the customer of this in the order confirmation without any undue delay. If the product is permanently unavailable, the provider will not accept the customer order. If the product is only temporarily unavailable, the provider will also inform the customer of this without any undue delay.
The following delivery restrictions apply: The provider only delivers to customers who have their usual residence (billing address) in one of the following countries and can provide a delivery address in the same country: Germany, Austria, Switzerland, Spain

§ 4 Prices, payment methods, shipping costs

All prices on the provider's website include the applicable statutory sales tax.
The customer can pay in advance, PayPal or Klarna. If the customer is an entrepreneur, payments can also be made by direct debit or on account.
The corresponding shipping costs are stated to the customer in the order form and are to be borne by the customer unless the customer exercises his or her right of withdrawal. If the order is fulfilled in partial deliveries at the request of the provider, shipping costs will only be incurred for the first partial delivery. However, if the order is fulfilled in partial deliveries at the request of the customer, the costs of each partial delivery must be borne by the customer.

The goods are dispatched by post. The shipping risk is borne by the customer unless he is a consumer.

§ 5 Warranty rights, quality, guarantee

The provider is liable for defects in accordance with the applicable legal regulations.
With regard to the nature of hair extensions made from natural hair, it is agreed that, as a natural product, they must only be of average type and quality in view of their natural irregularities and uniqueness, and must have a level of durability and resistance corresponding to the average head of hair depending on the length, hair type and hair color . Changes in hair color in particular are a natural process and do not represent defects. Improper use by the customer or use that does not correspond to the quality of a natural product does not constitute the provider's warranty obligations.
Any seller guarantees given by the provider for certain items or manufacturer guarantees granted by the manufacturers of certain items apply in addition to claims for material or legal defects. Details of the scope of such guarantees can be found in the guarantee conditions which may accompany the articles.

§ 6 Liability

Customer claims for compensation are excluded. Excluded from this are claims for damages by the customer resulting from injury to life, body, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages that are based on an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents . Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract and on whose proper fulfillment the customer can rely.
In the event of a breach of essential contractual obligations, the provider is only liable for the contract-typical, foreseeable damage if this was caused simply through negligence, unless the customer is claiming damages due to injury to life, body or health.
The restrictions in paragraphs 1 and 2 also apply to the benefit of the provider's legal representatives and vicarious agents if claims are asserted directly against them.
The liability limitations resulting from paragraphs 1 and 2 do not apply if the provider fraudulently concealed the defect or provided a guarantee for the quality of the item. The same applies if the provider and the customer have reached an agreement about the nature of the item. The provisions of the Product Liability Act remain unaffected.

§ 7 Consumer's right of withdrawal

(1) When concluding a distance selling transaction, consumers have a statutory right of withdrawal, about which the provider informs below in accordance with the legal model. The exceptions to the right of withdrawal are regulated in paragraph 2. A sample cancellation form can be found in paragraph 3.

You have the right to cancel this contract within fourteen days without giving any reasons.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

In order to exercise your right of withdrawal, you must contact us (HerEXTENSIONS, Ms. Mandy Eigler, Rothenbergstr. 26, 86316 Friedberg) by email herextensions@outlook.de inform you of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use the attached sample cancellation form, although this is not mandatory.

In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.

Consequences of revocation

If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the low-cost standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment.

We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired. You bear the direct costs of returning the goods.

The right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. Corresponding goods are sealed with a numbered hygiene seal and can be identified from this.

§ 8 Final provisions

The law of the Federal Republic of Germany applies to contracts between the provider and the customer, excluding the UN Convention on Contracts for the International Sale of Goods. The legal regulations regarding the restriction of the choice of law and the applicability of mandatory regulations, in particular the state in which the customer as a consumer has his habitual residence, remain unaffected.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the provider's registered office.
The provider's registered office is agreed as the place of fulfillment of all obligations arising from this contractual relationship.
The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes regarding contractual obligations arising from online sales contracts. We are neither willing nor obliged to take part in a dispute resolution procedure before a consumer arbitration board.
